
Declaration of Pecuniary Interest
Under the Municipal Conflict of Interest Act Section 5.1, a Member of Council or Local Board must file a written statement (Declaration of Pecuniary Interest) after the member discloses a pecuniary (financial) interest.
Section 6.1 of the Act requires the Township of North Frontenac to establish and maintain a public registry of pecuniary interests declared by Members of Council and Members of Local Boards. The registry must include the original written declaration provided by the Member of Council or Local Board and must be made available to the public.
How does a Member disclose a Pecuniary Interest?
The legislation requires that a Member of Council or Local Board shall:
- Prior to any consideration of the matter at the meeting, disclose the interest and general nature thereof;
- Not take part in the discussion of, or vote on any question in respect of the matter; and
- Not in any way whether before, during, or after the meeting to influence the voting on any such question.
Where the meeting is closed to the public, in addition to complying with the above requirements, the member shall leave the meeting or the part of the meeting during which the matter is under consideration.
Where the interest of the member has not been disclosed as required by reason of the member’s absence from the meeting, the member shall disclose the interest and comply with the requirements at the first meeting of the Council or the Local Board, as the case may be, attended by the member.
At a meeting at which a member declares a pecuniary interest, or as soon as possible afterwards, the member shall file a written statement of the interest and its general nature with the Clerk of the Township or Secretary of the Committee or Local Board, as the case may be.
Record of Disclosure
Every declaration of pecuniary interest made, where the meeting is open to the public, shall be recorded in the minutes of the meeting by the Clerk of the Township or Secretary of the Committee or Local Board.
Every declaration made, but not the general nature of that interest, where the meeting is closed to the public, shall be recorded in the minutes of the next meeting that is open to the public by the Clerk of the Township or Secretary of the Committee or Local Board.
